Accounts and current scope

We’re building for the Canadian wind and water community, including kite, windsurf, wing, foil and eFoil enthusiasts. People in other countries may join, subject to applicable law and the availability of the service.

For now, listings are for individuals using personal profiles to sell their own personal gear. Business listings and shop inventory aren’t currently accepted, including stock posted through a personal profile. We may introduce clearly labelled business profiles for used gear later, with separate selling terms. Business and shop inventory will remain outside this giveaway.

Give accurate account information, use your own account, protect your credentials and tell us about suspected misuse. Do not impersonate another person or create extra accounts to evade restrictions or increase contest entries. You must have the legal capacity or any permission required to use the service and enter the transactions you arrange.

Listing rules

List gear you own and have the right to sell. Describe the make, model, age, size, condition, repairs, modifications and material faults accurately. Use photos you have permission to post. Keep the price, currency, availability and any proposed delivery or pickup conditions clear and current.

Do not post stolen or counterfeit goods, unlawful items, misleading or duplicate spam listings, undisclosed commercial inventory, or another person’s private information. Do not offer gear subject to an unresolved safety recall or conceal safety issues. Damaged or incomplete gear must be clearly described; it does not qualify for the giveaway unless it meets all contest requirements after review.

Listing gear is currently free. This is separate from the asking price you charge another member. Any future optional paid feature or fee will be explained before you choose it; these Terms do not authorize an undisclosed charge.

When gear sells, mark the listing Sold and leave it on Windsporter if you want its earned entry to remain in the contest draws. You can request removal or close your account, with any effect on contest eligibility explained under the contest rules and our Privacy Policy.

Buying and selling

Windsporter helps people discover gear and contact one another. For member-to-member transactions, the buyer and seller make their own agreement about the item, payment, inspection, pickup, shipping, returns and any other sale conditions. Windsporter is not the buyer or seller of that personal gear and does not provide escrow, transaction insurance or a guarantee that a deal will complete.

Buyers should ask questions, check the seller and inspect the gear before committing. Sellers must deliver what they agree to sell and disclose material issues. Each party is responsible for its applicable taxes, lawful payments and delivery obligations. Follow any special carrier or legal requirements that apply to equipment or batteries.

Used windsports gear can involve serious risks. A listing, listing review or contest approval is not an inspection, safety certification, equipment recommendation or guarantee of suitability. Obtain appropriate expertise, check recalls and manufacturer guidance, and assess whether equipment is safe and suitable for your intended use.

Report suspected fraud or a problematic listing to us. We may assist with information or moderation where appropriate, but do not promise to resolve a private sale dispute, recover money or replace gear. Nothing here removes a legal obligation or non-waivable right that applies to a buyer, seller or Windsporter.

Community conduct and content

Be respectful. Do not harass, threaten, discriminate, scam, send spam, manipulate reviews, publish private information, interfere with accounts or systems, scrape members’ contact details, or use Windsporter for unlawful activity. Do not use messaging or notification features for unsolicited marketing.

You keep ownership of the content you submit. You give Windsporter a limited, non-exclusive permission to host, store, process, resize and display that content to operate the service and show your listings, including search results and listing previews. This is not a transfer of ownership or a general right to use your private messages in advertising.

Public listings and profile content can be viewed or shared by others. Post only material you have the right to share, and get permission before sharing someone else’s identifiable information. We handle personal information as described in the Privacy Policy.

Giveaway rules

Entering the giveaway is optional and requires agreement to its separate contest terms in the listing form. The contest terms and announced bonus-offer rules govern eligibility, entries, prize choices and draws. The giveaway page explains the seller milestones and current prize choices.

Only approved eligible personal-gear listings earn listing entries, up to three per person. Final qualification is decided by Windsporter after review, at its discretion. Early eligible entries carry into later milestone draws. Additional listings or accounts do not create additional qualifying sellers.

Prizes are donated and availability can change. Announced bonus opportunities may change the eligible entry pool and odds. There is no fixed promise of a draw date based on how quickly seller milestones are reached. Read the contest terms before entering.

Fake accounts, fake listings or other attempts to game the giveaway will result in disqualification and a ban from Windsporter. A change to these general Terms does not retroactively change a completed draw.

Moderation and account closure

We may review, decline, remove or restrict listings, content or accounts that breach these Terms, appear fraudulent, create safety/security risks or require action under law. We may make formatting changes needed to display content, without treating them as verification of the seller’s claims. Review does not mean we have checked every statement or detected every problem.

We may suspend or close accounts for serious or repeated misuse, including contest manipulation. Contact us if you believe a decision was made in error. You can stop using the service or request account closure; limited records may remain where needed for legal, security, moderation or contest purposes as described in the Privacy Policy.

Service limits and your rights

We work to keep Windsporter useful and available, but cannot promise uninterrupted access, error-free content or the accuracy, ownership, quality or safety of a member’s gear. Features and availability may change. Third-party websites and services have their own terms and privacy practices.

To the extent permitted by law, Windsporter is not responsible for losses arising from another member’s conduct, inaccurate listings, private sale arrangements, unsafe equipment use or service interruptions beyond our reasonable control. You remain responsible for your own conduct, content and sale obligations.

Nothing in these Terms excludes a liability, privacy right, consumer protection or other right that applicable law does not allow us to exclude. Mandatory laws that protect you continue to apply.

Changes and applicable law

We may update these Terms as the service develops. We will post the revised date and provide appropriate notice or request agreement where required for material changes. New business-selling or paid features will have their relevant conditions explained before use.

These Terms are governed by the laws of Alberta and applicable Canadian federal law, except where mandatory laws where you live require otherwise. Nothing here prevents access to a regulator or a court or process that you are entitled to use under applicable law.
